General Terms and Conditions of Sale
SAS LM PARTS with a capital of 1000€, whose head office is located at 26 rue de la Roquille – 37250 Veigne - France, registered with the RCS TOURS under number 951326875, VAT number FR77951326875 ("the Seller"), operates the website https://lmparts.fr/, from which it sells key cases for Renault and Dacia cars.
1 - Scope
Any order implies the acceptance by the Customer of the entirety of these general conditions of sale. The fact that the Seller may derogate from any of the clauses of these general conditions for a specific operation shall not be construed as a waiver of the benefit of that clause. These general conditions of sale govern sales between LM PARTS and the Customer, which implies the acceptance without reserve of these conditions.
2 - Product
The products offered are those listed on the website "https://lmparts.fr/" of the company LM Parts, within the limit of available stocks. LM Parts reserves the right to modify at any time the assortment of products. Each product is presented on the website in the form of a description summarizing its main technical characteristics: "Key cases for hands-free Renault / Dacia systems". The photographs are as faithful as possible but do not commit the Seller in any way. The sale of the products presented on the website https://lmparts.fr/ is intended for all buyers residing in countries that fully authorize the entry of these products on their territory.
3 – Orders - Formation of the contract
In the case of an order placed on the website, the Customer may only validate his order after checking the box "You accept the terms and conditions of sale": he then undertakes to respect these general conditions of sale. The Seller reserves the right to request, before shipping the order, identity documents such as an identity card (national identity card, passport, etc.) and proof of domicile at the delivery and/or billing address (lease receipt, electricity bill, etc.). In case of non-presentation of said documents, the Seller may cancel the order without prior notice.
4 - Price
The prices indicated on this site include all taxes, shipping and handling charges. Any customs duties, taxes and international transport costs are not included in the price of the product or shipping costs and are the responsibility of the buyer. Please check with your country's customs office for the amount of these additional fees before placing an order. If the package is refused or abandoned at customs, we reserve the right to deduct them from the initial refund amount. 5 - Payment
Payment for purchases is made either by credit card (Visa or Eurocard - Mastercard only), or by Paypal. In the event of a payment, the Seller will not deliver until the payment has been confirmed.
6 - Termination clause
In the event of a purchase by a company or administration and in the event of default of payment, the sale will be automatically terminated and may give rise to the allocation of damages and interest to the benefit of the Seller. The amount of these damages is set at the amount of the terminated sale.
7 - Warranty
The products sold on the website www.lmparts.fr benefit from the legal guarantee of conformity provided for by articles L.217-4 and following in case of defects of conformity of the product to the contract, and L 111-1 and R 111-1 of the Consumer Code and the legal guarantee against hidden defects affecting the products delivered and making them unfit for the intended use provided for by articles 1641 and following of the Civil Code in case of hidden defects of the product sold. LM PARTS key cases are products painted by body shops in an artisanal way, so the paint and varnish finish may be slightly imperfect due to handcrafted production and not in a factory. A slight paint or varnish imperfection cannot be considered as a defective product. For example, a grain in the varnish located on the edges of the case is an acceptable imperfection. Similarly, the shade of a new paint on the LM Parts case may differ from that present on a bodywork that has already lived several years under variable conditions. LM Parts cannot therefore be held responsible for this difference in shade. The LM Parts key case is an original LM Parts product that has no connection with the Renault or Dacia manufacturer. The customer must therefore keep his original case which may be requested by the dealer in the event of a warranty. LM Parts cannot therefore be held responsible for any dispute with a dealer who requests the complete original key.
8 - Intellectual Property
All elements of the www.lmparts.fr website, whether visual or sound, including the technology used, are protected by copyright, trademark law and, more generally, by intellectual property law. They are the exclusive property of LM PARTS. Any total or partial reproduction of the www.lmparts.fr website from elements of the site without the express authorization of LM PARTS is prohibited and constitutes an infringement sanctioned by the Intellectual Property Code.
9 - Returns & Exchanges
If the product was not purchased on the website www.lmparts.fr, the customer must contact the seller from whom the product was purchased. The individual consumer has a period of fourteen (14) calendar days from receipt of the product to exercise his right of withdrawal, without having to justify his decision or pay any penalties, except for return costs, for the purpose of exchange or refund. Saturdays, Sundays, holidays or non-working days are included in the calculation of the withdrawal period. When it expires on a Saturday, Sunday, holiday or non-working day, it is extended until the first following working day. However, subject to the Products being returned in their original packaging and in perfect condition within fourteen (14) days at least following notification of the Customer's decision to withdraw to the Seller: The product and its packaging must be in perfect condition. The product must be in its original packaging. If applicable, the accessories must also be returned in perfect condition. Incomplete, worn, damaged or soiled products will not be refunded. An acknowledgement of receipt will be sent to the Customer by the Seller. This acknowledgement of receipt will specify the procedures to be followed by the Customer. The customer has fourteen (14) days from the communication of his decision to withdraw to return in perfect condition the goods not giving satisfaction. Once the package is received, our quality control team will need 2 to 15 working days to verify that the content complies with/fulfills the conditions mentioned above. We will contact you by email regarding the refund. In case of exercise of the right of withdrawal within the aforementioned period, only the price of the product(s) purchased and the standard shipping costs are refunded. The return costs are borne by the consumer. In case of partial return, the automatic discounts may be deducted from the refunded price (for example, automatic discount if purchase of two cases but return of only one). The exchange (subject to availability) or the refund will be made within a period of fourteen (14) days from the date on which the seller was informed of the decision to withdraw or upon recovery of the goods. In case of a refund, it will be made using the same means of payment as that used by the consumer for the initial transaction, unless express agreement of the consumer for another means of payment not incurring any costs for the latter. The transport of the returned products is the responsibility of the Customer, consequently any damage suffered by a product returned makes the right of withdrawal ineffective following what is specified in the present article. Products that can be returned by mail due to their technical characteristics, it is up to the Customer to contact the postal services to find out the amount of return fees. We advise the Customer to use a tracking number to confirm the proper routing of the return. In order to facilitate this procedure, we also advise the Customer to indicate his order number and his name/first name in the return package. Otherwise, it is possible that we will not be able to identify him.
10 - Delivery & Transport
Once your order is placed, LM PARTS commits to ship it within a period of 7 working days subject to available stock. This period may be extended during busy periods (promotions, end-of-year holidays, etc.). For metropolitan France, the maximum delivery time is 45 days from the day the order was placed. After this period, you may request a refund. We ship orders from Monday to Friday. Orders placed on Saturday, Sunday, or during holidays will not be shipped until the next business day. In case of stock shortage, LM PARTS commits to restock the product as soon as possible or to refund the order. If your order contains a product temporarily unavailable for sale (pre-order, low stock, out of stock, etc.), the order will be put on hold until all products are available. You can contact us to send your order in two shipments, but you will have to cover the additional shipping costs. We strongly advise the customer to check at the time of delivery and before signing the delivery slip any damage possibly suffered during transport and the conformity with the order. In this case, the customer has the right to refuse the delivery and to make express reservations on the delivery slip. If he notices damage strictly related to transport after the departure of the carrier, we invite the customer to report it to him. In case of problem during the delivery (damaged product, missing product, etc.), please keep everything you have received (envelope, summary, invoice, etc.) in order to show us photos so that we can assist you. The inability to provide the required information will complicate any claim on your part. If the Customer makes a mistake in the destination address and a return of mail is made by the carrier, the shipping costs for the new shipment are at the Customer's expense. The name of the recipient must imperatively appear on the mailbox at the indicated address. In case of return of mail for reason "unclaimed package", the package/mail will only be shipped again after receipt of the shipping costs which will have to be borne by the Customer. If the indication of Tracked Letter by La Poste confirms the distribution of the package to the address indicated during the order: the transaction will be considered as perfectly valid and no refund can be claimed. Any dispute in this case will have to be treated with La Poste. The deadlines below are strictly for informational purposes and LM PARTS cannot be held responsible for the non-compliance with the deadlines announced by third parties (carriers, La Poste, or any other subcontractor or supplier). 12 - Reservation of ownership
The transfer of ownership of the goods will only take place after full payment of the price by the Customer, and this whatever the date of delivery of the said products. Payment is only deemed to have been made after full collection of the sums due. The transfer of the risks of loss and deterioration of the products of the Seller will be realized at the time of the taking of possession/material delivery of the said products by the Customer.
13 - Force majeure
The Seller's liability cannot be invoked if the non-performance or delay in the performance of one of his obligations described in these general conditions of sale results from a case of force majeure. The latter is characterized by three criteria: externality with respect to the author, irresistibility and unpredictability.
14 - Competent court and mediation
Any dispute relating to the interpretation and performance of these general conditions of sale is subject to French law. For professional customers, in the absence of an amicable resolution, the dispute will be brought before the Commercial Court of Tours - France.
For consumer customers, the rules set by the Code of Civil Procedure will apply. For consumer customers, in the absence of an amicable resolution, the customer may resort to a conventional mediation. 16 – Personal data
The nominative data requested from the Customer are necessary for the processing of his order and the establishment of invoices. The Customer has, by writing to the address indicated in the header, a right of modification, rectification, withdrawal and opposition concerning the information concerning him, in accordance with the CNIL provisions.
When the customer transfers personal data to LM PARTS, he accepts that LM PARTS communicates it to its logistical partners (national or international) in order to carry out the contract. In no case will LM PARTS transfer its data for commercial purposes.
17 - Miscellaneous
In case one of the clauses of these general conditions of sale should be declared contrary to the law or in any other way inexecutable, this clause would be modified or canceled without resulting in the nullity of all of these general conditions of sale.
